Charterparty Viability Checklist for Tanker Owners

In a world increasingly disrupted by geopolitics, conflicts, sanctions, pandemics and other major events, whilst the nature of the disruption may vary the same key considerations are likely to apply when it comes to charterparty viability.
As such, INTERTANKO’s Documentary and Insurance & Legal Committees have produced a Charterparty Viability Checklist for Tanker Owners.
This document is intended to assist tanker owners in assessing whether a previously agreed charterparty remains viable where external events (e.g. war, sanctions, blockades, terrorism, pandemics, cyber disruption or government restrictions) materially affect the ability to perform voyages as originally contemplated.
The Guidance provides a practical framework to assess:
- whether performance remains lawful, safe and possible;
- what contractual mechanisms may permit alternative performance or refusal;
- whether performance remains insured.
